STAKEHOLDER COMMENTS MATRIX ON CONSUMER PROTECTION BILL AND COMPLAINT MANAGEMENT MECHANISM REGULATIONS

The Competition and Fair Trading Commission is undertaking a review of the Legal and Regulatory Framework for Consumer Protection in Malawi with the view to come up with a framework that is robust and offers an effective complaints handling, redress and dispute resolution mechanism.

The review is financed by the African Development Fund under the Digitalization, Financial Inclusion and Competitiveness (DFIC) Project, implemented through the Project Implementation Unit in the Ministry of Finance and Economic Affairs. The main goal of the project is to improve access to digital financial services and strengthen the competitiveness of the Malawian economy through digitalization with a specific focus on reaching populations traditionally excluded such as women, youth, MSMEs, people living with disabilities, internally displaced, financially illiterate and rural populations.

One of the components of the project involves a review of the Consumer Protection Act (Cap. 48:10 of the Laws of Malawi); drafting a Consumer Protection Bill; formulation of a Complaints Management Mechanism; and development of a Consumer Protection Strategy. These instruments are aimed at guiding stakeholders including policymakers, market regulators, suppliers and users of goods and services, etc to ensure a robust engagement in consumer protection in Malawi.

In light of the above, the Commission is collecting stakeholder views on the draft instruments before they can be adopted and processed further. Stakeholders are invited to present their comments through the standard format which can be accessed through the Commission’s website www.cftc.mw along with the draft instruments.

The comments can be sent to the Commission through letter to the Commission no later than 28th July, 2025.
