RECENT DECISIONS BY THE COMPETITION AND FAIR TRADING COMMISSION

The Competition and Fair Trading Commission (“the Commission”) held its 69th meeting on 23rd July, 2024, to consider and adjudicate over cases on unfair trading conducts and anti-competitive business practices.

The Commission adjudicated over a total of 90 cases, which included 77 cases on unfair trading practices and 13 on anti-competitive business practices. Out of the 90 cases, 63 were closed at preliminary stage for among others lack of merit and early resolution of the issues at hand.

Although these cases have been decided after the Competition and Fair Trading Act (CFTA), 2024 entered into force on 1st July,2024, the orders are based on the repealed CFTA,1998 under which the charges were made. This is in accordance with Section 76 of the CFTA, 2024 which provides for transitional matters.
