ALLEGED SUPPLY OF PRODUCTS LIKELY TO CAUSE INJURY TO HEALTH OR PHYSICAL HARM TO CONSUMERS AND UNCONSCIONABLE CONDUCT BY GLALLE ENTERPRISES

On 21st October 2022, the Commission commenced investigations against Glalle Enterprises on alleged supply of products likely to cause injury to health or physical harm to consumers, and unconscionable conduct.

Specifically, on 18th October 2022, the Commission conducted an inspection at Glalle Enterprises Bar located at Area 49 in Lilongwe and found that the said bar was stocking expired products. Actually, the Commission noted that some of the products had expired as far back as December 2021, and yet they were still being supplied to customers.

Although the Commission sent a Notice of Investigation to the Respondent and subsequent follow up letters and reminders, the Respondent did not cooperate.

Following deliberations, the Commission resolved to issue the following Orders:

  1. That the Respondent should pay a fine of MK500,000.00 for supplying products likely to cause injury to health or physical harm to consumers and unconscionable conduct in the trade of goods.
  2. That the Respondent should pay a fine MK500,000 for failing to cooperate with the Commission during its investigations by failing to furnish the Commission with information when requested to do so.
