ALLEGED EXCLUDING LIABILITY FOR DEFECTIVE GOODS, AND UNCONSCIONABLE CONDUCT BY MZUZU SPRINT PRINTERS

On 5th January 2023, the Commission commenced investigations against Mzuzu Sprint Printers of Mzuzu on allegations of excluding liability, and unconscionable conduct.

 Specifically, the Complainant alleged that, on 30th June 2021, he purchased a printer from the Respondent’s shop at a price of MK120,000.00 which turned out to be defective. The Respondent tried, without success, to fix the printer.

At a later stage, the Respondent proposed that the defective product should be exchanged with another printer which was of a higher grade, and thus the Complainant was required to pay an additional amount of MK60,000.00. The Complainant agreed to the exchange and accordingly made the extra payment in September 2021, and got another printer. However, the second printer was also found to be defective. The Respondent attempted to repair the second item but again without success.

Following deliberations, the Commission ordered that the Respondent should refund the Complainant the amount of MK180,000.00 which is the total amount paid for the printer.
