He is an accomplished Lawyer who was admitted to the Malawi Bar in 2004. He holds a Bachelor of Laws (Honours) Degree LLB (Hons) from University of Malawi’s School of Law at Chancellor College in Zomba in 2003; Master of Business Administration (MBA) Degree from University of Malawi obtained in 2008; Master of Laws Degree (LLM) majoring in Commercial Law from University of Minnesota Law School in United States of America (USA) obtained in 2009 and Master of Communications Management (MCM) Degree from University of New Buckinghamshire of London; United Kingdom obtained in 2015. Currently, he is finalising studies with the Institute of Chartered Secretaries and Administrators (ICSA) and will qualify as a Chartered Secretary and Administrator soon.
Mr. Kaphale is a Hubert H. Humphrey Fellow from University of Minnesota Law School in United States of America (USA). This is a Leadership Professional Development Program offered by the USA Government. As a Fellow, he was an Intern in the Legal Department at Minnesota Public Utilities Commission (MPUC) in United States of America under the auspices of the United States of America Government thereby regulating Telecommunications, Energy and Oil & Gas industries. He also worked as an Intern at one of the world’s leading Law Firms in London White & Case LLP under the International Lawyers for Africa (ILFA) Program in London in 2015.
He has over 15 years’ working experience at a Senior Management level in Public Institutions in Malawi. Prior to joining Competition and Fair Trading Commission, he worked as Director of Administration and Company Secretary for ADMARC Limited from 2018-2020; Director of Administration and Corporate Services for Malawi Housing Corporation from 2016-18 and at Malawi Communications Regulatory Authority (MACRA) for twelve (12) years from 2004-2016 where he rose from the post of Legal and Consumer Affairs Manager, Deputy Director of Legal Services, and finally Director of Legal Services and Corporate Secretary.
Mr. Kaphale has both professional and practical working experience and understanding in Competition and Fair Trading issues which he got when he was Director of Legal Services and Corporate Secretary for MACRA in dealing with Competition and Fair Trading issues in the Information and Communication Technologies (ICT) sector. In fact, he initiated a Memorandum of Understanding (MOU) on the working relationship between MACRA and CFTC on Competition and Fair Trading issues in the ICT industry.
